Terms & Conditions – Golden Neck

Welcome to goldenneck.com (“the Site”), owned and operated by Golden Neck (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, you may not access or use the Site.
1. Acceptance of Terms
By placing an order on our Site, you warrant that you are at least 18 years old or have reached the age of majority in your jurisdiction, and you are legally capable of entering into binding contracts.
2. Products and Services
a. Product Descriptions: We strive to be as accurate as possible in the descriptions of our products, including colors, dimensions, and materials. However, we do not warrant that product descriptions or other content of the Site are accurate, complete, reliable, current, or error-free.
b. Pricing: All prices displayed on the Site are in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) where applicable, unless otherwise stated.
c. Availability: All products are subject to availability. We reserve the right to limit the quantity of products we supply; to supply only part of an order or to divide orders.
d. Imitation Jewelry Disclaimer: Golden Neck specializes in imitation jewelry. While we use high-quality materials and craftsmanship for our imitation jewelry, it is not fine jewelry made of precious metals or gemstones.
3. Order Placement and Acceptance
- Order Process: To place an order, you will select the desired products and add them to your cart. You will then proceed to checkout, where you will provide your shipping and billing information and select your payment method.
- Order Confirmation: After you place an order, you will receive an email confirmation acknowledging receipt of your order. This email does not constitute acceptance of your order. All orders are subject to our acceptance.
- Order Acceptance: Our acceptance of your order will take place when the products are dispatched from our warehouse, at which point a contract will come into existence between you and us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product description, or suspected fraud.
4. Payment Terms
- Payment Methods: We accept various payment methods, including Cash on Delivery (COD), credit/debit cards, net banking, and other digital payment options as displayed on our Site through our secure payment gateway partners.
- Payment Security: All online payments are processed through secure third-party payment gateways. We do not store your credit card or debit card details on our servers. Your financial information is encrypted and handled directly by the payment gateway.
- Cash on Delivery (COD): For COD orders, payment is due at the time of delivery. Please ensure you have the exact amount ready. We may limit the maximum value for COD orders.
5. Shipping and Delivery
- Shipping Zones: We ship to addresses within India.
- Delivery Timeframes: Estimated delivery times are provided at the time of checkout and in your order confirmation email. These are estimates only and are not guaranteed. Actual delivery times may vary due to unforeseen circumstances, logistics, and your location.
- Shipping Charges: Shipping charges, if any, will be calculated and displayed at checkout. We may offer free shipping for orders exceeding a certain value.
- Risk of Loss: The risk of loss and title for items purchased from Golden Neck pass to you upon our delivery to the carrier. We are not responsible for any delays, damages, or losses incurred during transit once the package has been handed over to the shipping carrier.
- Incorrect Address: It is your responsibility to provide accurate shipping information. We are not responsible for delays or non-delivery due to incorrect or incomplete addresses provided by you. Any costs incurred due to re-delivery attempts or returns due to incorrect addresses will be borne by the customer.
6. Returns, Exchanges, and Refunds
- Return Policy: Please refer to our dedicated “Return & Exchange Policy” page [link to your Return Policy page] for detailed information on eligibility, process, and conditions for returns and exchanges.
- Defective or Damaged Products: If you receive a defective or damaged product, please contact us immediately upon receipt (within 24-48 hours) with photographic evidence. We will assess the issue and provide a suitable resolution, which may include a replacement, repair, or refund.
- Refunds: Refunds, if applicable, will be processed according to our Return & Exchange Policy and will be issued to the original payment method or as store credit. Processing times for refunds may vary.
7. User Accounts
- Account Creation: You may choose to create an account on our Site. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
- Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any reason, including but not limited to breach of these Terms.
8. Intellectual Property
digital downloads, data compilations, and software, is the property of Golden Neck or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content on the Site without our express written permission.
9. Prohibited Uses
You agree not to use the Site: a. In any way that violates any applicable federal, state, local, or international law or regulation. b. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way. c. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation. d. To impersonate or attempt to impersonate Golden Neck, a Golden Neck employee, another user, or any other person or entity. e. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Golden Neck or users of the Site or expose them to liability.
10. Disclaimer of Warranties
The Site and all products and services delivered to you through the Site are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
11. Limitation of Liability
In no event shall Golden Neck, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
12. Indemnification
You agree to defend, indemnify, and hold harmless Golden Neck, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.
13. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
15. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
16. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Golden Neck regarding your use of the Site, superseding any prior agreements between you and us regarding your use of the Site.
